1. Eligibility & Acceptance

By accessing or using this website, you confirm that you are at least the age of majority in your jurisdiction and legally capable of entering into binding agreements.

By placing an order, you agree to be bound by these Terms of Service, our Warranty & Refund Policy, Shipping Policy (if applicable), and any additional disclaimers presented on this website.

 

 

2. Product Use & Legal Compliance

HMD Fabrications LLC sells aftermarket automotive exhaust components, including electronic valved exhaust systems and related fabrication products.

Unless otherwise explicitly stated:

  • Products are intended primarily for off-road and/or competition use only

  • Products may not be legal for use on public roads in certain jurisdictions, including California

  • Products may not comply with emissions, noise, or other regulatory requirements, including but not limited to EPA, CARB, DOT, or local laws

It is the customer’s sole responsibility to determine and ensure compliance with all applicable federal, state, and local laws prior to installation or use.

HMD Fabrications LLC makes no representation or guarantee that any product is street legal in any jurisdiction.

 

 

3. Installation & Use Disclaimer

Professional installation is strongly recommended for all products.

Improper installation, modification, or use may result in vehicle damage, personal injury, or legal consequences.

HMD Fabrications LLC is not responsible for damages or losses resulting from:

  • Improper installation

  • Misuse or abuse

  • Unauthorized modification

  • Failure to follow provided instructions or wiring requirements

All products are used at the customer’s own risk.

 

 

4. Assumption of Risk

By purchasing and using HMD Fabrications LLC products, you acknowledge and accept that automotive performance modifications carry inherent risks.

These risks may include increased noise, vibration, heat, emissions changes, or mechanical stress on vehicle components.

HMD Fabrications LLC shall not be liable for any secondary, incidental, or consequential damage, including but not limited to engine, turbocharger, drivetrain, exhaust system, or vehicle electronic failures.

 

 

5. Orders, Pricing & Availability

All prices are listed in USD unless otherwise stated.

Prices, product specifications, and availability are subject to change without notice.

We reserve the right to refuse, cancel, or limit any order at our discretion, including but not limited to errors in pricing, product description, or inventory availability.

 

 

6. Returns & Refunds

Returns and refunds are governed by our Warranty & Refund Policy, which is incorporated into these Terms by reference.

In general:

  • Installed, used, modified, test-fitted, or custom-built products are not eligible for return

  • Returns must meet the conditions outlined in the Warranty & Refund Policy

 

 

7. Warranty Disclaimer

Except where expressly stated in our written Warranty Policy, products are sold “as is” and “as available.”

HMD Fabrications LLC disclaims all warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.

No verbal or written statement outside of the official Warranty Policy shall create any additional warranty.

 

 

8. No Reliance Clause

Customers acknowledge and agree that they are not relying on any statements, marketing materials, performance claims, or verbal communications outside of these Terms when purchasing products.

 

 

9. Limitation of Liability

To the maximum extent permitted by law, HMD Fabrications LLC shall not be liable for any indirect, incidental, special, or consequential damages.

This includes, but is not limited to:

  • Loss of use

  • Loss of vehicle functionality

  • Loss of profits or revenue

  • Repair costs beyond the original product purchase price

  • Legal penalties, citations, or fines resulting from product use

In all cases, HMD Fabrications LLC’s total liability shall not exceed the amount paid for the product giving rise to the claim.

You agree to indemnify, defend, and hold harmless HMD Fabrications LLC, its owners, employees, and affiliates from any claims, damages, losses, liabilities, or expenses arising out of:

  • Use or misuse of products

  • Failure to comply with applicable laws

  • Installation, modification, or repair of products
